The Homeowner Protection Amendment Act has provided the HPO with the enforcement tools necessary to carry out its regulatory role in the residential construction industry and increase protection for buyers of new homes.

The HPO now has the power to issue compliance orders and administrative monetary penalties. These may be issued to any individual or company who fails to comply with the Homeowner Protection Act or the regulations. Most compliance with the Act is sought and obtained on a voluntary basis. However, where necessary, the HPO submits cases to Crown Counsel to consider for prosecution of offences under the Homeowner Protection Act.
