Compliance Orders - 2007
Marine Drive Properties Ltd. ("MDPL") and Elke Loof-Koehler ("Koehler") conducted the business of a residential builder without being licensed (September 2007 to December 2007) and built, offered for sale and/or sold 24 new homes in Ucluelet, B.C., (the "New Home") without any of the New Homes being covered by home warranty insurance (April 2006 to December 2007) in contravention of section 14(1) and section 22(1) of the Homeowner Protection Act (the "Act"). On December 13, 2007, a Compliance Order was issued by the Homeowner Protection Office ("HPO") to MDPL and Koehler directing that all building, offering for sale, and selling of New Homes cease immediately, and that MDPL obtain an HPO Residential Builder Licence and enroll all 24 New Homes with home warranty insurance by December 19, 2007.
