Carol Ann Jensen (“C.A. Jensen”) and Cory Kristofor Jensen (“C.K. Jensen”) (together, the “Jensens”), contrary to sections 14(1) and 22(1) of the Homeowner Protection Act (the “Act”), built a new home in Birch Island, B.C., (the “New Home”) in, or around, 2009 and 2010 without being a Homeowner Protection Office (“HPO”) Licensed Residential Builder (“LRB”) and without the New Home being covered by a policy of home warranty insurance.  On February 13, 2012, the HPO issued Compliance Order 12-0008 to C.A. Jensen and C.K. Jensen directing that the Jensens either become an HPO LRB pursuant to section 14 of the Act and obtain home warranty insurance for the New Home pursuant to section 22 of the Act, or the Jensens provide proof that the New Home was built by an HPO LRB and is enrolled with home warranty insurance pursuant to section 22 of the Act, or that C.A. Jensen or C.K. Jensen apply for, and be issued, an Owner Builder Authorization (“OBA”) for the New Home pursuant to section 20 (1) of the Act and section 4.1 (2) of the Homeowner Protection Act Regulation (the “Regulations”), and fulfill the requirements of being an owner builder. The Jensens were directed to comply with Compliance Order 12-0008 by April 20, 2012.

Gurvinder Singh Cheema (“G. Cheema”) and Sarbjit Kaur Cheema (“S. Cheema”) (together, the “Cheemas”), contrary to subsections 20.1 (1) (b) and 21(2)(a), of the Homeowner Protection Act (the “Act”), regarding a new home in Delta, B.C., (the "New Home"), for which an Owner Builder Authorization had been issued, sold the New Home on, or around, July 3, 2010, within the 12-month time period after the New Home was built, and failed to provide the purchasers of the New Home with a disclosure notice, in a form satisfactory to the Homeowner Protection Office (the “HPO”) registrar, stating, among other facts, whether or not the New Home is covered by home warranty insurance. On January 17, 2012, the HPO issued Compliance Order 12-0002 to the Cheemas, directing that the Cheemas become an HPO Licensed Residential Builder and obtain home warranty insurance for the New Home by March 9, 2012.

Jasvir Kaur Kaloya (“J. Kaloya”) and Kulwinder Singh Kaloya (“K. Kaloya”) (together, the “Kaloyas”), contrary to subsections 20.1 (1) (b) and 21(2)(a), of the Homeowner Protection Act (the “Act”), regarding a new home in Surrey, B.C., (the "New Home"), for which an Owner Builder Authorization had been issued, sold the New Home on, or around, December 31, 2009, within the 12-month time period after the New Home was built, and failed to provide the purchasers of the New Home with a disclosure notice, in a form satisfactory to the Homeowner Protection Office (the “HPO”) registrar, stating, among other facts, whether or not the New Home is covered by home warranty insurance. On January 17, 2012, the HPO issued Compliance Order 12-0003 to the Kaloyas, directing that the Kaloyas become an HPO Licensed Residential Builder and obtain home warranty insurance for the New Home by February 17, 2012. Complied.

Jessy Shergill (“Shergill”), contrary to subsections 20.1 (1) (b) and 21(2)(a), of the Homeowner Protection Act (the “Act”), regarding a new home in Surrey, B.C., (the "New Home"), for which an Owner Builder Authorization had been issued, signed a Purchase and Sale Agreement for the sale of the New Home on, or around, March 11, 2011, within the 12-month time period after the New Home was built, and failed to provide the purchasers of the New Home with a disclosure notice, in a form satisfactory to the Homeowner Protection Office (the “HPO”) registrar, stating, among other facts, whether or not the New Home is covered by home warranty insurance. On February 13, 2012, the HPO issued Compliance Order 12-0007 to Shergill, directing that Shergill become an HPO Licensed Residential Builder and obtain home warranty insurance for the New Home by April 13, 2012. 

Michael James Ahlm (“M. Ahlm”), contrary to section 14(1) of the Homeowner Protection Act (“Act”), regarding two new homes in Salmon Arm, B.C., (the “New Homes”) conducted the business of a residential builder without a Homeowner Protection Office (“HPO”) Residential Builder Licence by offering and/or marketing for sale the New Homes between the dates of, on or before, December 7, 2011, and February 13, 2012. On February 13, 2012, the HPO issued Compliance Order 12-0005  directing M. Ahlm to immediately cease the offering for sale, marketing, completion of any Purchase/Sale Agreement that may be in place, and/or actual sale of the New Homes, provide the HPO evidence of the sale offering cancellations for the New Homes, and become an HPO Licensed Residential Builder pursuant to section 14 of the Act prior to renewing any marketing efforts, offering for sale and/or selling either of the New Homes. M. Ahlm was directed to comply with Compliance Order 12-0005 by March 9, 2012. Complied.

Paramjit Longia (“P. Longia”) and Harbinder Longia (“H. Longia”) (together, the “Longias”), contrary to subsections 20.1 (1) (b) and 21(2)(a), of the Homeowner Protection Act (the “Act”), regarding a new home in Vancouver, B.C., (the "New Home"), for which an Owner Builder Authorization had been issued, sold the New Home on, or around, September 12, 2011, within the 12-month time period after the New Home was built, and failed to provide the purchasers of the New Home with a disclosure notice, in a form satisfactory to the Homeowner Protection Office (the “HPO”) registrar, stating, among other facts, whether or not the New Home is covered by home warranty insurance. On February 21, 2012, the HPO issued Compliance Order 12-0004 to the Longias, directing that the Longias become an HPO Licensed Residential Builder and obtain home warranty insurance for the New Home by April 13, 2012. 

Paul Sinclair (“Sinclair”), contrary to subsections 20.1 (1) (b) and 21(2)(a), of the Homeowner Protection Act (the “Act”), regarding a new home in Nanaimo, B.C., (the "New Home"), for which an Owner Builder Authorization had been issued, sold the New Home on, or around, July 8, 2011, within the 12-month time period after the New Home was built, and failed to provide the purchasers of the New Home with a disclosure notice, in a form satisfactory to the Homeowner Protection Office (the “HPO”) registrar, stating, among other facts, whether or not the New Home is covered by home warranty insurance. On January 17, 2012, the HPO issued Compliance Order 12-0001 to Sinclair, directing that Sinclair become an HPO Licensed Residential Builder and obtain home warranty insurance for the New Home by March 16, 2012.

Stonegate Properties Ltd (“Stonegate”), Malkit Singh Dhesi (“Dhesi”) and Sukhminder Singh Gill (“Gill”), contrary to section 14(1) of the Homeowner Protection Act (“Act”), regarding a new home in Maple Ridge, B.C., (the “New Home”) conducted the business of a residential builder without a Homeowner Protection Office (“HPO”) Residential Builder Licence by offering and/or marketing for sale the New Home between the dates of, on or before, August 24, 2011, and November 4, 2011. On February 13, 2012, the HPO issued Compliance Order 12-0006 directing Stonegate, Dhesi, and Gill to immediately cease the offering for sale, marketing, completion of any Purchase/Sale Agreement that may be in place, and/or actual sale of the New Home, and become an HPO Licensed Residential Builder pursuant to section 14 of the Act prior to renewing any marketing efforts or offering for sale and/or selling the New Home. Stonegate, Dhesi, and Gill were directed to comply with Compliance Order 12-0006 by February 24, 2012.
