Eclissi Developments Ltd. (EDL), William Chan (W.Chan) and Peter Wing Yiu Chan (P.Chan), contrary to section 14(1) of the Homeowner Protection Act (Act), conducted the business of a residential builder without a valid Homeowner Protection Office (HPO) Residential Builder Licence between the dates July 31, 2009, and February 10, 2010, regarding a multi-unit building in Richmond, BC (the New Homes). On February 10, 2010, the HPO issued Compliance Order 10-0003 to EDL, W.Chan and P.Chan, directing that they cease carrying on the business of a residential builder as defined in the Act, that the offering for sale of the New Homes cease immediately, and that they immediately become an HPO Licensed Residential Builder pursuant to the Act and its Regulations. Complied.
Gary Spink (G. Spink), contrary to sections 14(1) and 22(1) of the Homeowner Protection Act (Act), began construction of a new home in Royston, BC, (the New Home) on, or around September 18, 2009, without being a Homeowner Protection Office (HPO) Licensed Residential Builder (LRB) and without the New Home being enrolled with a policy of home warranty insurance. On January 26, 2010, the Homeowner Protection Office (HPO) issued Compliance Order 10-0002 to G. Spink directing that he cease carrying on the business of a residential builder as defined in the Act, including ceasing construction of the New Home, that he become an HPO LRB and that he enroll the New Home with a policy of home warranty insurance by March 8, 2010. The HPO issued Amended Compliance Order 10-0002-1 to G. Spink on February 11, 2010, changing the date of compliance with Compliance Order 10-0002 to March 15, 2010, and providing G. Spink with a further option by which he could comply with the Act.
Cadmar Construction Ltd. (CCL) and Sean Snowdon (S. Snowdon), contrary to section 14(1) of the Homeowner Protection Act (Act), built and offered a new home for sale in Courtenay, BC, (the New Home) after his Homeowner Protection Office Residential Builder Licence (RBL) had expired. On February 1, 2010, the HPO issued Compliance Order 10-0001 to CCL and S. Snowdon directing that they cease carrying on the business of a residential builder as defined in the Act, and be issued an HPO RBL by March 5, 2010.
Jason Jasninderpal Singh Grewal (J.S. Grewal), contrary to subsections 20.1(1)(b) of the Homeowner Protection Act (Act), regarding a new home in Richmond, BC, (the New Home) for which an Owner Builder Authorization had been issued, offered for sale and sold the New Home on August 27, 2009, within the 12-month period after the New Home was built. On December 23, 2009, the HPO issued Compliance Order 09-0028 to J.S. Grewal directing that he become a Homeowner Protection Office Licensed Residential Builder by January 22, 2010.
2008 Enterprises Ltd. (2008 Ltd.), Yong Min Ping (Ping) and John Hwak Chew Woo (Woo), contrary to section 14(1) of the Homeowner Protection Act (Act), conducted the business of a residential builder without a valid HPO Residential Builder Licence between the dates September 30, 2009, and November 27, 2009, regarding a multi-unit building in Vancouver, BC (the Property). Ping and Woo, contrary to section 22 of the Act, built and offered for sale the 4 new residential units contained within the multi-unit building on the Property (the New Homes), between the dates of June 24, 2009, and November 27, 2009, without the New Homes being covering by home warranty insurance. On December 3, 2009, the HPO issued Compliance Order 09-0027 to 2008 Ltd., Ping and Woo, directing that they cease carrying on the business of a residential builder as defined in the Act, that they become an HPO Licensed Residential Builder and obtain home warranty insurance for each of the New Homes located on the Property or register a restrictive covenant on the title to the Property ensuring that the each of the New Homes may only be used for rental purposes and restricting the sale, or other disposition of any dwelling unit within the Property for 10 years from the date of first occupancy of a dwelling unit in the building. Complied.
Forest Latimer (Latimer) contrary to sections 14(1) and 22(1) of the Homeowner Protection Act (Act), after having been denied a Homeowner Protection Office (HPO) Owner Builder Authorization (OBA) built a new home near Fernie, BC, (the New Home) between February 2008 and May 30, 2009, without being an HPO Licensed Residential Builder (LRB) and without the New Home being covered by home warranty insurance. On December 21, 2009, the HPO issued Compliance Order 09-0026 to Latimer requiring that Latimer become an HPO LRB and enroll the New Home with home warranty insurance by January 28, 2010.
Spring Like Construction Company (SLCC) and Ming Lie Han (M. Han), contrary to sections 14(1), 22(1) of the Homeowner Protection Act (Act), built and offered a new home for sale in Chilliwack, BC, (the New Home) after their Homeowner Protection Office (HPO) Residential Builder License (RBL) had expired and while the New Home was not enrolled with home warranty insurance. On December 2, 2009, the HPO issued Compliance Order 09-0025 to SLCC and M. Han directing that they cease carrying on the business of a residential builder, as defined in the Act, including offering the New Home for sale and that they be issued an HPO RBL, and enroll the New Home in a policy of home warranty insurance by December 31, 2009.
Leo Ronse (Ronse), contrary to subsections 20.1(1)(a) and 20.1(1)(b) of the Homeowner Protection Act (Act), built a new home in Langley, BC, (the New Home), for which an Owner Builder Authorization had been issued, offered the New Home for sale between March 31, 2009 and July 6, 2009, while the New Home was being constructed and again after the New Home was built between August 27, 2009, and November 27, 2009, within the prescribed twelve-month period after the New Home was built. On October 28, 2009, Compliance Order 09-0022 was issued to Ronse, directing that he immediately cancel the marketing effort on the New Home and either become a Homeowner Protection Office (HPO) Licensed Residential Builder and obtain home warranty insurance for the New Home by December 18, 2009, before renewing any marketing efforts for the New Home, or immediately personally occupy and own the New Home for the prescribed twelve month period.
Tharen Soroka (Soroka) and TDS Forestry Contracting Ltd. (TDS), contrary to section 14(1) and 22(1) of the Homeowner Protection Act (Act), constructed a new home near Powder King, BC (theNew Home) during the period of May 2008 to August 2009, without being a Homeowner Protection Office (HPO) Licensed Residential Builder (LRB) and without the New Home being enrolled and covered by a policy of home warranty insurance. On November 19, 2009, the HPO issued Compliance Order CO09-0021 to Soroka and TDS directing that they become an HPO LRB and enroll the New Home with a policy of home warranty insurance or apply for and be issued an HPO Owner Builder Authorization for the New Home.
Home and Style Construction Inc. (HSCI) and Marian (Mario) Bitoiu (M. Bitoiu), contrary to sections 14(1) and 22(1) of the Homeowner Protection Act (Act), built a new home in New Westminster, BC, (the New Home) during the period of on, or around, January 8, 2008, and September 18, 2009, without being an Homeowner Protection Office (HPO) Licensed Residential Builder (LRB) and without the New Home being covered with home warranty insurance. On May 19, 2009, the HPO issued Compliance Order 09-0008 to HSCI and M. Bitoiu directing that they cease carrying on the business of a residential builder as defined in the Act, become an HPO LRB and obtain home warranty insurance for the New Home byJune 19, 2009. On October 7, 2009, the HPO issued Amended Compliance Order 09-0008-1 to HSCI and M. Bitoiu providing clarification of the directions contained in Compliance Order 09-0008 and providing November 13, 2009, as the date by which compliance with these directions must be achieved. All other directions contained in the Compliance Order 09-0008 remain unchanged.
Robert Holloway (Holloway) and Neighbours Contracting Ltd. (Neighbours), contrary to sections 14(1) and 22 (1) of the Homeowner Protection Act (Act), built a new home in Nanaimo, BC, (the New Home) during the period of October 9, 2007, to July 11, 2008, without being a Homeowner Protection Office (HPO) Licensed Residential Builder (LRB) and without the New Home being covered with home warranty insurance. On July 14, 2009, Compliance Order 09-0010 was issued by the HPO to Holloway and Neighbours directing they cease carrying on the business of a residential builder as defined in the Act until such time as they obtain home warranty insurance for the New Home. On October 9, 2009 Amended Compliance Order ACO09-0010-1 was issued to Holloway and Neighbours changing the compliance date from August 24, 2009, to November 20, 2009, and directing they immediately cease carrying on the business of a residential builder, immediately become an HPO LRB and enroll the New Home they built with home warranty insurance as required by the Act and Regulations.
William Bland (Bland) and Lucas DeCicco (DeCicco), contrary to sections 14(1) and 22(1) of the Homeowner Protection Act (Act) built two new homes near Shawnigan Lake, BC (the New Homes) during the period of November 2007 to August 2008 without being a Homeowner Protection Office (HPO) Licenced Residential Builder (LRB) and without the New Homes being covered with home warranty insurance. On June 9, 2009, Compliance Order 09-0009 was issued by the HPO to Bland and DeCicco directing they cease carrying on the business of a residential builder as defined in the Act and that they become an HPO LRB and obtain home warranty insurance for the New Homes. Amended Compliance Order 09-0009-1 dated September 24, 2009, was issued by the HPO to Bland and DeCicco providing a new date by which compliance was directed to be achieved. All other directions in Compliance Order 09-0009 remained unchanged in Amended Compliance Order 09-0009-1.
Mike Nahal (M. Nahal) and Rite Homes Ltd. (RHL) started construction on 4 new homes and one multi-unit building (the New Homes) in the Prince George, BC, area between August 2007 and December 2009. Although M. Nahal and RHL held a valid Homeowner Protection Office (HPO) Licence (#27105)at the time construction commenced on each of the New Homes , HPO LRB 27105 expired on May 31, 2008. Three of the New Homes were enrolled with home warranty insurance when construction on those three homes commenced, however, they were de-enrolled from home warranty insurance on May 13, 2008. Between May 13, 2008, and October 7, 2009, M. Nahal and RHL, contrary to sections 14(1) and 22(1) of the Homeowner Protection Act (Act), continued to build and/or offer for sale each of the New Homes. Compliance Order 09-0016, dated October 7, 2009, was issued to M. Nahal and RHL directing M. Nahal and RHL to become an HPO LRB and enroll each of New Homes with home warranty insurance.

Robert Holloway (Holloway) and Neighbours Contracting Ltd. (Neighbours), contrary to sections 14(1) and 22 (1) of the Homeowner Protection Act (Act), built a new home in Nanaimo, BC, (New Home) during the period of October 9, 2007, to July 11, 2008, without being a Homeowner Protection Office (HPO) Licensed Residential Builder (LRB) and without the New Home being covered with home warranty insurance. On July 14, 2009, Compliance Order 09-0010 was issued by the HPO to Holloway and Neighbours directing they cease carrying on the business of a residential builder as defined in the Act until such time as they obtain home warranty insurance for the New Home.
Craig Snyder (Snyder), contrary to section 21(2)(a) of the Homeowner Protection Act (Act), sold a new home in Qualicum Beach, BC, (New Home) on, or about July 30, 2009, without providing a Disclosure Notice to the prospective purchaser(s) of the New Home. On September 8, 2009, the Homeowner Protection Office (HPO) issued Compliance Order 09-0018 to Snyder directing him, pursuant to section 4.1(3) of the Homeowner Protection Act Regulation, to provide the HPO with the date of first occupancy of the New Home and the names of the tradespersons who contributed to the building of the New Home. In addition, pursuant to section 21(2)(a) of the Act, Snyder was directed to obtain a Disclosure Notice from the HPO and provide a copy of the Disclosure Notice to the purchasers of the New Home and provide the HPO evidence of the same. Complied.
Stanley Thomas Holmes (Holmes), contrary to subsections 20.1(1)(a) and 20.1(1)(b) of the Homeowner Protection Act (Act), regarding a new home in Courtenay, BC, (New Home), for which an Owner Builder Authorization had been issued, offered for sale and sold the New Home between February 29, 2008, and July 15, 2008, while the New Home was being constructed and within the 12-month period after the New Home was built. On April 24, 2009, Compliance Order 09-0006 was issued to Holmes and Double T Developments, directing that they become an Homeowner Protection Office (HPO) Licensed Residential Builder and obtain home warranty insurance for the New Home by May 25, 2009. On October 7, 2009, the HPO issued Compliance Order 09-0006-1 to Holmes and DTD providing November 2, 2009, as the new date by which to comply with the directions contained in Compliance Order 09-0006. All other directions contained in CO 09-0006 remain unchanged.
Savinder Gill (Gill), contrary to sections 14(1) and 22(1) of the Homeowner Protection Act, built a new home in Surrey, BC, (the New Home), during the period of May 2005 to July 2007, without being a Homeowner Protection Office (HPO) Licensed Residential Builder (LRB) and without the New Home being covered with home warranty insurance. On August 4, 2009, the HPO issued Compliance Order 09-0014 to Gill directing he become an HPO LRB and obtain home warranty insurance for the New Home.
Vic Van Isle Construction Ltd. (VVICL), Kenneth Hendrickson, Paul Jones, Mario Lopez, Ken Biss and Bruce Walker (VVICL et al), contrary to section 22(1) of the Homeowner Protection Act, built 4 new homes consisting of one new residential dwelling unit in the Columbia-Shuswap Regional Disrict, BC, and one multi-family building consisting of three new residential dwelling units in Tofino, BC, (together, the New Homes) without any of the New Homes being covered by home warranty insurance. On July 10, 2009, the HPO issued Compliance Order 09-0013 to VVICL et al. directing each of the parties to cease carrying on the business of a residential builder until such time as the VVICL’s HPO Licence was changed from suspended to active and to enroll each of the New Homes with home warranty insurance by August 10, 2009. Complied.
Teresa Robson (Robson) and David Aitken (Aitken), contrary to sections 14(1) and 22(1) of the Homeowner Protection Act (Act), began a substantial reconstruction of a home near Chilliwack, BC, (the New Home) during the period of January 5, 2006, to June 30, 2009, without being a Homeowner Protection Office (HPO) Licensed Residential Builder (LRB) and without the New Home being covered by home warranty insurance and without receiving an HPO Owner Builder Authorization (OBA), as required by the Act. On June 30, 2009, the HPO issued Compliance Order 09-0011 to Robson and Aitken directing that they become an HPO LRB and enroll the New Home with home warranty insurance or obtain an HPO OBA by July 31, 2009.
Jason Chernoff (Chernoff) and Jaylo Land Developments (JLD) on, or around, September 4, 2008, contrary to section 14(1) of the Homeowner Protection Act, entered into a contract to build and did build a new home in Castlegar, BC, without being an Homeowner Protection Office (HPO) Licenced Residential Builder (LRB). On August 28, 2009, the HPO issued compliance Order 09-0005 to Chernoff and JLD directing that they become an HPO LRB or register 0753961 BC Ltd., which is an HPO LRB and for which Chernoff is a Director, with the Corporate Registry of British Columbia as “doing business as Jaylo Land Developments” by September 18, 2009.

Nhut Phu Chieng (Chieng) and Lan Ngoc Woo (Woo), contrary to subsections 20.1(1)(a), 20.1(1)(b) and 21(2)(a), of the Homeowner Protection Act, regarding a new home in Vancouver, BC, (the New Home), for which an Owner Builder Authorization had been issued, offered for sale the New Home between January 13, 2009, and March 18, 2009, while the New Home was being constructed, sold the New Home within the 12-month time period after the New Home was built, and failed to provide the purchasers of the New Home with a disclosure notice, in a form satisfactory to the Homeowner Protection Office (HPO) registrar, stating whether or not the New Home is covered by home warranty insurance. On May 1, 2009, the HPO issued Compliance Order 09-0004 to Chieng and Woo, directing that they become an HPO Licensed Residential Builder and obtain home warranty insurance for the New Home by June 5, 2009. Complied.
Derrick Graham Burke (Burke), contrary to sections 14(1) and 22(1) of the Homeowner Protection Act, built, offered for sale and sold a new home in Kaleden, BC, between the dates of August 1, 2007, and June 18, 2008, without being an HPO Licensed Residential Builder and without that new home being covered with home warranty insurance. On April 23, 2009, a Compliance Order was issued by the HPO to Burke directing Burke to become an HPO Licensed Residential Builder and obtain home warranty insurance for the new home by June 3, 2009.
Eelake Liau (Liau) and 0720958 BC Ltd. (0720958), contrary to sections 14(1) and 22(1) of the Homeowner Protection Act (Act), built a new home in Vancouver, BC, (the New Home) during the period of March 31, 2008, and April 23, 2009, without being a Homeowner Protection Office (HPO) Licensed Residential Builder (LRB) and without that New Home being covered with home warranty insurance. Liau and 0720958 were issued Compliance Order 08-0020 on June 25, 2008. On April 23, 2009, the HPO issued Amended Compliance Order 08-0020-1 to Liau and 0720958 providing May 26, 2009, as the new date by which compliance with Compliance Order 08-0020 was directed to be achieved. All other directions contained in Compliance Order 08-0020 remain unchanged. Complied.
Stanley Thomas Holmes (Holmes), contrary to subsections 20.1(1)(a) and 20.1(1)(b) of the Homeowner Protection Act (Act), regarding a new home in Courtenay, BC, (the New Home), for which an Owner Builder Authorization had been issued, offered for sale and sold the New Home between February 29, 2008, and July 15, 2008, while the New Home was being constructed and within the 12-month period after the New Home was built. On April 24, 2009, Compliance Order 09-0006 was issued to Holmes and Double T Developments, directing that they become an Homeowner Protection Office (HPO) Licensed Residential Builder and obtain home warranty insurance for the New Home by May 25, 2009. On October 7, 2009, the HPO issued Compliance Order 09-0006-1 to Holmes and DTD providing November 2, 2009, as the new date by which to comply with the directions contained in Compliance Order 09-0006. All other directions contained in CO 09-0006 remain unchanged.
Darren Marquis (D. Marquis) and Nancy Marquis (N. Marquis), contrary to section 21(2)(a) of the Homeowner Protection Act (Act), sold a new home in Powell River, BC, (the New Home) on, or about February 10, 2009, without providing a Disclosure Notice for the New Home to the purchasers. On April 21, 2009, the HPO issued Compliance Order 09-0002 to D. Marquis and N. Marquis directing them to obtain a Disclosure Notice from the Homeowner Protection Office (HPO) and provide the HPO evidence that they have in fact provided this Disclosure Notice to the purchasers pursuant to section 21(2)(a) of the Act. Binder Singh Lalli (Lalli), contrary to section 14(1) of the Homeowner Protection Act (Act), conducted the business of a residential builder without being a Homeowner Protection Office (HPO) Licensed Residential Builder between the dates December 31, 2006, and September 2, 2008, regarding a multi-unit building in Vancouver, BC (Project). Lalli, contrary to section 22 of the Act, built and offered for sale new homes contained within the Project, between the dates of November 10, 2005, and September 2, 2008, without those new homes being covering by home warranty insurance or without a restrictive covenant being registered on the title to the Property restricting the sale or other disposition of any dwelling unit in the Project for 10 years from the date of first occupancy of a dwelling unit in the Project. On September 2, 2008, the HPO issued Amended Compliance Order 08-0018-1 to Lalli and 0732433 BC Ltd. providing a new date by which compliance was directed to be achieved. All other directions contained in Compliance Order 08-0018 remain unchanged. Complied.
Dalbir Singh Randhawa and Parvinder Kaur Randhawa (the Randhawas), contrary to sections 14(1), 22(1) and 22(1.1) of the Homeowner Protection Act, built, offered for sale and sold a new home in Langley, BC, (the New Home) during the period of July 30, 2007 and August 28, 2008, without being a Homeowner Protection Office (HPO) Licenced Residential Builder (LRB) and without the New Home being covered with home warranty insurance. On October 24, 2008, Compliance Order 08-0024 was issued by the HPO to the Randhawas directing that they become an HPO LRB and obtain home warranty insurance for the New Home by November 28, 2008.
Amandeep Singh Sidhu (Sidhu), contrary to Section 14(1) and 22(1.1) of the Homeowner Protection Act (the Act), sold a new home in Chilliwack, BC, (the New Home) on, or around, July 21, 2008, without being a Homeowner Protection Office (HPO) Licensed Residential Builder (LRB) and without the New Home being covered by home warranty insurance. On May 12, 2008, as a result of prior attempts to sell the New Home, Sidhu was served an Information Letter from the HPO, dated May 8, 2008, whereby, Sidhu was advised that no further attempts be made to sell the New Home until the New Home was covered by home warranty insurance as required by the Act. On September 11, 2008, Compliance Order 08-0023 was issued by the HPO to Sidhu directing him to become an HPO LRB and obtain home warranty insurance for the New Home.
Whiskey Dock Developments Ltd. (WDDL), 0694017 BC Ltd. and Wayne Wenstob (Wenstob), contrary to section 14(1) of the Homeowner Protection Act (Act) , conducted the business of a residential builder without being an HPO Licensed Residential Builder between the dates March 11, 2003 and June 26, 2008, regarding a multi-unit building in Ucluelet, BC (the Project). WDDL, 0694017 BC Ltd. and Wenstob, contrary to section 22 of the Act, built, offered for sale and/or sold new homes contained within the Project, between the dates of March 2003 and June 26, 2008 without those new homes being covering by home warranty insurance or without a restrictive covenant being registered on the title to the Property restricting the sale of other disposition of any dwelling unit in the Project for 10 years from the date of first occupancy of a dwelling unit in the Project. On June 26, 2008, a Compliance Order was issued by the HPO to WDDL, BC Ltd. and Wenstob directing that they cease carrying on the business of a residential builder as defined in the Act, that they become an HPO Licensed Residential Builder and obtain home warranty insurance for the Project and for each new home located in the Project or register a restrictive covenant on the title to the Project ensuring that the Project may only be used for rental purposes and restricting the sale, or other disposition of any dwelling unit within the Project for 10 years from the date of first occupancy of a dwelling unit in the Project.

On June 25, 2008, a Compliance Order was issued by the HPO to Liau and 0720958 BC Ltd. directing that they cease carrying on the business of a residential builder as defined in the Act, that they become an HPO Licensed Residential Builder and obtain home warranty insurance for the new home, or that Liau provide the HPO evidence that he is using the new home for personal use and that he not offer for sale, or sell, the new home while it is being constructed or for a period of 12 months after it has been built.
Leon Roy Pendleton (Pendleton), contrary to sections 14(1) and 22(1) of the Homeowner Protection Act, built a new home in Edgewater, BC (the New Home), during the period of February 4, 2004 and July 8, 2008, without being a Homeowner Protection Office (HPO) Licenced Residential Builder, without the New Home being covered with home warranty insurance and without either an Owner Builder Declaration Disclosure Notice or Owner Builder Authorization being filed with the Regional District of Central Kootenay (RDCK) Building Department. On July 8, 2008, a Compliance Order was issued by the HPO to Pendleton directing that he apply to the HPO for an Owner Builder Authorization (OBA) and cease any construction activity regarding the New Home until such time as he obtains an OBA and submits that OBA to the RDCK Building Department by August 29, 2008.
Binder Singh Lalli (Lalli), contrary to sections 14(1) and 22(1) of the Homeowner Protection Act (Act), conducted the business of a residential builder without being an HPO Licensed Residential Builder between the dates December 31, 2006 and June 18, 2008, regarding a multi-unit building in Vancouver, BC (the Project). Lalli contrary to section 22 of the Act, built and offered for sale new homes contained within the Project, between the dates of November 10, 2005 and June 18, 2008 without those new homes being covering by home warranty insurance or without a restrictive covenant being registered on the title to the Property restricting the sale of other disposition of any dwelling unit in the Project for 10 years from the date of first occupancy of a dwelling unit in the Project. On June 18, 2008, a Compliance Order was issued by the HPO to Lalli and 0732433 BC Ltd. directing that they cease carrying on the business of a residential builder as defined in the Act, that they become an HPO Licensed Residential Builder and obtain home warranty insurance for the Project and for each new home located in the Project or register a restrictive covenant on the title to the Project ensuring that the Project may only be used for rental purposes and restricting the sale, or other disposition of any dwelling unit within the Project for 10 years from the date of first occupancy of a dwelling unit in the Project.
Carmen Jacobson (Jacobson), contrary to sections 14(1) and 22(1) of the Homeowner Protection Act, built, offered for sale and sold a new home near Golden, BC, (the New Home) in, and around, April 2008, without being a Homeowner Protection Office (HPO) Licenced Residential Builder (LRB) and without the New Home being covered with home warranty insurance. On June 6, 2008, a Compliance Order was issued by the HPO to Jacobson directing that she become an LRB and obtain home warranty insurance for the New Home by June 30, 2008.
Hardashan Johal (H. Johal), contrary to sections 14(1) and 22(1) of the Homeowner Protection Act, built a new home in Vancouver, BC, during the period of May 30, 2007 and May 2, 2008, without being an HPO Licensed Residential Builder and without that new home being covered with home warranty insurance. On May 2, 2008, a Compliance Order was issued by the HPO to H. Johal directing that he cease carrying on the business of a residential builder as defined in the Act, that he become an HPO Licensed Residential Builder and obtain home warranty insurance for the new home, or that he provide the HPO evidence that he is using the new home for personal use and not offer for sale or sell the new home while it is being constructed and for a period of 12 months after it has been built. Yasser Salame (Salame), contrary to sections 14(1) and 22(1) of the Homeowner Protection Act, built, offered for sale and sold a new home in Fort St. John, BC, (the New Home) during the period of February 26, 2007 and April 24, 2008, without being a Homeowner Protection Office (HPO) Licenced Residential Builder (LRB), without the New Home being covered with home warranty insurance and contrary to the permission granted by the HPO to sell the New Home on the condition that it was enrolled with home warranty insurance prior to the New Home actually selling. On April 29, 2008, a Compliance Order was issued by the HPO to Salame directing that he become an HPO LRB and obtain home warranty insurance for the New Home by May 28, 2008.
On December 21, 2007, Marine Drive Properties Ltd (MDPL) and Elke Loof-Koehler (Koehler) were sent an invoice from the Homeowner Protection Office (the HPO) in the amount of $23,865.07 (the HPO Invoice) for licensing fees and reconstruction levy fees associated with the construction of 24 condominium units being built in Ucluelet, BC. As a result of this HPO Invoice not being paid in the time required, the HPO issued a Compliance Order on April 1, 2008, directing MDPL and Koehler to pay the HPO Invoice pursuant to the condition of MDPL’s HPO Residential Builder Licence #30378, issued on December 20, 2007, along with $928.43 for interest on those outstanding fees. MDPL and Khoeler were ordered to pay the HPO Invoice by April 15, 2008. Complied.
Balbir Singh Ghag (B. Ghag) and Kulwinder Kaur Ghag (K. Ghag), contrary to sections 14(1) and 22(1) of the Homeowner Protection Act, built and offered for sale a new home in Delta, BC, during the period of March 7, 2007 and April 2, 2008, without being an HPO Licenced Residential Builder and without that new home being covered with home warranty insurance. On April 2, 2008, a Compliance Order was issued by the HPO to B. Ghag and K. Ghag directing that the offering for sale of the new home by Ghag cease immediately, that they provide the HPO evidence of the cancellation of the sale offer for the new home, and that B. Ghag and K. Ghag become an HPO Licenced Residential Builder and obtain home warranty insurance for the new home, obtain permission from the HPO Registrar to offer to sell and sell the new home, or own and occupy the new home for personal use immediately upon its completion for a reasonable and verifiable period of time. Ahemed Patel (A. Patel) and Naseem Patel (N. Patel), contrary to sections 14(1) and 22(1) of the Homeowner Protection Act, built a new home in Burnaby, BC, during the period of September 30, 2006 and April 14, 2008, without a valid HPO Residential Builder Licence and without that new home being covered with home warranty insurance. On April 14, 2008, a Compliance Order was issued by the HPO to A. Patel and N. Patel directing that they cease carrying on the business of a residential builder as defined in the Act, that they provide the HPO evidence that they are using the new home for personal use, or that they become an HPO Licenced Residential Builder and obtain home warranty insurance for the new home. Sukhjiwan Singh Dhak (S. Dhak) and Resham Kaur Dhak (R. Dhak), contrary to section 22 of the Homeowner Protection Act and sections 2 (2) and 19 (1) of the Homeowner Protection Act Regulation, built and offered for sale a duplex in Vancouver, BC, during the period of June 2, 2006 and April 14, 2008, without the duplex being covered with home warranty insurance or without a restrictive covenant being registered on the title to the duplex restricting the sale or other disposition of any dwelling unit in the duplex for 10 years from the date of first occupancy of a dwelling unit in the duplex. On April 15, 2008, a Compliance Order was issued by the HPO to S. Dhak and R. Dhak directing that the offering for sale of the duplex by Dhak cease immediately, that they provide the HPO evidence of the cancellation of the sale offer for the duplex, and that they obtain home warranty for the duplex, obtain permission from the HPO Registrar to offer to sell and sell the duplex, or register a restrictive covenant on the title to the duplex ensuring that it may only be used for rental purposes and restricting the sale, or other disposition of any dwelling unit within the duplex, for 10 years from the date of first occupancy of a dwelling unit in the duplex. On April 21, 2008, a Compliance Order was issued by the HPO to ZSG Enterprises Ltd. and Shen Qing Sun directing that they cease carrying on the business of a residential builder as defined in the Act, that they become an HPO Licensed Residential Builder and obtain home warranty insurance for the new home. Eugeny Pashkovsky (E. Pashkovsky) and Assia Pashkovsky (A. Pashkovsky), contrary to section 22(1) of the Homeowner Protection Act, built and offered for sale a new home in Richmond, BC, during the period of January 26, 2007 and March 18, 2008, without that new home being covered with home warranty insurance. On March 18, 2008, a Compliance Order was issued by the HPO to E. Pashkovsky and A. Pashkovsky directing that the offering for sale of the new home by Pashkovsky cease immediately, that they provide the HPO evidence of the cancellation of the sale offer for the new home and that they obtain home warranty insurance for the new home, obtain permission from the HPO Registrar to offer to sell and sell the new home, or own and occupy the new home for personal use immediately upon its completion for a reasonable and verifiable period of time. John Peter Wall (Wall), contrary to sections 14(1) and 22(1) of the Homeowner Protection Act, built and offered for sale a new home in Vancouver, BC, during the period of August 14, 2006 and March 3, 2008, without being an HPO Licenced Residential Builder and without that new home being covered with home warranty insurance. On March 3, 2008, a Compliance Order was issued by the HPO to Wall directing that the offering for sale of the new home by Wall cease immediately, that Wall provide the HPO evidence of the cancellation of the sale offer for the new home, and that Wall become an HPO Licenced Residential Builder and obtain home warranty insurance for the new home, obtain permission from the HPO Registrar to offer to sell and sell the new home, or own and occupy the new home for personal use. Marvin Hirano (M. Hirano) and Katherine Hirano (K. Hirano), contrary to sections 14(1) and 22(1) of the Homeowner Protection Act (the Act), built a new home (the New Home) in Elko, BC, during the period of August 22, 2005 and February 27, 2008, without being a Homeowner Protection Office (HPO) Licenced Residential Builder (LRB) and without the New Home being covered with home warranty insurance. M. Hirano and K. Hirano also built another new home using an Owner Builder Declaration and Disclosure Notice (OBBDN) (the New OBDDN Home), in Elko, BC, during that same period. On February 27, 2008 and July 8, 2008, a Compliance Order and amended Compliance Order respectively, were issued by the HPO to M. Hirano and K. Hirano directing that they either become a LRB and enroll the New Home in a policy of home warranty insurance or sell the New Home in its current stage of construction to either a LRB who would enroll the New Home in a policy of home warranty insurance or an individual who would either qualify to complete the New Home as an Owner Builder or hire an LRB to complete the New Home and enroll it in home warranty insurance. M. Hirano and K. Hirano were further directed to provide the HPO with the names and contact information of all potential purchasers of the New Home prior to a Purchase/Sale Agreement being entered into. M. Hirano and K. Hirano were also directed to provide the HPO with proof that they will be utilizing the New OBDDN Home for personal use by August 8, 2008.
Francisco Elvas (Elvas), contrary to sections 14(1) and 22(1) of the Homeowner Protection Act, built and offered for sale a new home in Coquitlam, BC, during the period of September 26, 2006 and February 25, 2008, without being an HPO Licenced Residential Builder and without that new home being covered with home warranty insurance. On February 25, 2008, a Compliance Order was issued by the HPO to Elvas directing that the offering for sale of the new home by Elvas cease immediately, that he provide the HPO evidence of the cancellation of the sale offer for the new home, and that Elvas become an HPO Licenced Residential Builder and obtain home warranty insurance for the new home, obtain permission from the HPO Registrar to offer to sell and sell the new home, or own and occupy the new home for personal use immediately upon its completion for a reasonable and verifiable period of time. Benstar Developments Ltd. (Benstar) and Harjit Dhaliwal (Dhaliwal) conducted the business of a residential builder without being licenced between the periods of October 31, 2006 and February 18, 2008, contrary to section 14(1) of the Homeowner Protection Act (Act). During this same time period, Benstar and Dhaliwal built 3 new homes in Chilliwack, BC, without any of those homes being covered by home warranty insurance, contrary to section 22(1) of the Act. On February 18, 2008, Compliance Order #08-0003 was issued to Benstar and Dhaliwal directing Benstar to become an HPO Licenced Residential Builder and enroll the three homes in question with home warranty insurance by March 10, 2008. The date for complying with Compliance Order 08-0003 was changed to July 24, 2008. All other directions contained in Compliance Order 08-0003 remain unchanged.
Harpreet Poonia (H. Poonia) sold a new home in Burnaby, BC on, or about, November 28, 2007, without the new home ever being occupied as a residence and without the new home being covered by home warranty insurance, in contravention of Section 22 (1) of the Homeowner Protection Act. On January 21, 2008, Compliance Order #08-0001 was issued by the HPO to H. Poonia directing that H. Poonia arrange home warranty insurance for the new home by February 18, 2008. Compliance Order #08-0001-1 was issued on February 27, 2008, amending the date by which compliance was required in Compliance Order #08-0001, from February 18, 2008 to April 15, 2008. Complied.
Marine Drive Properties Ltd. (MDPL) and Elke Loof-Koehler conducted the business of a residential builder without being licensed (September 2007 to December 2007) and built, offered for sale and/or sold 24 new homes in Ucluelet, British Columbia without any of the new homes being covered by home warranty insurance (April 2006 to December 2007) in contravention of Section 14(1) and Section 22(1) of the Homeowner Protection Act. On December 13, 2007, a Compliance Order was issued by the HPO to MDPL and Elke Loof-Koehler directing that all building, offering for sale, and selling of new homes cease immediately, and that MDPL obtain an HPO Residential Builder Licence and enroll all 24 new homes with home warranty insurance by December 19, 2007.
